Any body know why there are 3341 cases in March 2005 in EB2 I category, is this about the time PERM came?With out quarterly spill over bulletin is going to get stuck in March 2005 till the end of the USCIS financial year.
Yes, PERM was introduced on 28th Mar'05. I guess the high number of EB-2s was due to employers rushing to file under the old system.

1. Ball park figure is total of 218,000 visa wasted from previous years. How much of it will go to EBs (and others) will be based on how the recapture gets implemented. If we don't do anything and sit quiet, it may as well be ZERO. Nurses will walk away with the cake
2. President can pass an 'Executive Order' to pass interim relief. So it should be possible. It'll depend on the independent interpretation of the law by the White House, and it won't be based on whatever you read elsewhere.

Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?
Quite simply put EB3-ROW << EB2-I,C. So there is a faster chance of EB3-ROW going forward and being current before EB2-I becomes current. Therefore, with all other categories satisfied, it boils down to EB2-I/C and EB3-I/C. Thenceforth, as USCIS has indicated, the longest waiting PDs will be given the roll-over numbers, which is EB3-I.
So what will be the flow? I guess the following
EB1-> EB3-ROW (until current)
EB2-ROW -> EB2-I/C
Once Eb3-ROW becomes current
EB2-ROW -> EB2-I/C
EB3-ROW -> EB3-I/C
EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)
Please note, this is not going to be a quick fix for EB3-I. We are lowest on the totem pole, and barring legislative action, the only relief we can have is "earlier access" to numbers. Without a reversion of the complete horizontal spill over, older priority dates will continue to languish because EB2-I is going to remain sufficiently subscribed going forward.

Your Logic is Illogical in the first place...
In Labor substitution, a person who lands in US last friday, could substitute a labor and get ahead in line of a 2002 guy.
In Porting case he/she is the original beneficiary. So you comparing Porting to Labor Substitution is totally illogical...
PD porting is another labor sub in making. I hope I have presented my case logically to show who all are the people who are in position to be benefitted by this rule. Of course there will be some genuine cases too but on other hand think about the people in Eb2 line that will be severely affected.

Folks, first of all don't try to slam me for posting this.. Here is a note that I got from my law firm Paul Hastings.. I am subscribed to their immigration related email.. I got this today.. While this has come as a shock to me, they are still preparing to file my I485.. I did not hear this from my lawyer personally, but only through this newsletter. Update on Adjustment Filings for July
Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.
This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

Do you have F1 stamped or you just changed your status from F-1 to H-4?
My wife has H4 stamped on her passport which expired last year. We had got H4 extended last year, but has not been stamped. After that she changed status to F1 again not stamped. Now as per my lawyer's advice probably we will need to change her status back to H4.
My lawyer has suggested that it is not advisable to be on F-1 while applying for 485. You might argue that you are not the primary applicant ( on F1), and USCIS might buy that. But risks remain. Specifically if you have to travel out of country before your I-485 application is adjudicated you will have problem.
Since we all know that right now USCIS is just taking applications, and it might be mighty long time before applications are adjudicated, I have decided to not take risk applying on F1 status.

I called the department of state, visa's section to enquire about this PIMS verification. They said that KCC handles it. When I called KCC they said they cannot check ahead of time :mad:

Hey BP, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
assume eb1 demand = 5000, eb2 demand = 20000
we can easily see eb2 getting completely approved.
I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. Please check on following link.

Atlast got receipts by calling USCIS - after 1 days i saw checks cashed , receipts waiting. thanks for all ur help guys keeping looking for and as per USCIS they are bound to clear all the backlog by end of oct
