You should be able to file I-140 after your LC got cleared.
EB-3's visa dates are at '08-MAY-01', so you can not file I-485 until visa dates move to SEP 01[You don't need to wait for the Visa dates to current].
May be your lawyer is busy & thinking about some other case. Remind him about your priority date !

I never watch Lou Dobbs since I am never home in that time slot. But had a chance to switch to his program last week. Actually I did not want to see him but wanted to see which companies are sponsoring his show and would like to lose me as a customer.

If your PD is current for the July bulletin, then your application has to reach on July 2nd which is a Monday.
If your application was to reach on Saturday, June 30, and if the mail room guy is working overtime (assuming that the hell has frozen over), then your application will be sent back soon enough. Of course, the mail room guy is not going to open it on the same day; he/she is only going to stamp the date. And then when they really open it (2, 3, 4 weeks from now), they will send it back to you.
If your application was to reach on Sunday, July 1st, and if the mail room guy is working overtime (assuming that the hell has frozen over AGAIN), then your application will be accepted.
But if either of the two things above happen, I am not sure that GC is going to be my priority since hell would have frozen over...and I believe that's where we currently are stuck! :-)
So just take a chill pill, guys, your lawyer should know that the application should reach between Monday, July 2nd and Tuesday, July 31st. The end date can change once the August bulletin comes out.

My husband's petition is from a reputed company, and its an L1 blanket petition... the petition approval date is somewhere in Nov. 2007... does this mean that it would take a long/short time to update in PIMS?

Nice to know the film makers comment about our campaign. How about contacting them to get the hundreds of DVDs of 'Lage Raho Munnabhai' and send them to Walter Reed where flowers are going? Just a vague thought, I am sure someone else also mentioned similar thing earlier.

I dont expect USCIS to get all emotional because of our flowers and issue an update to their updated bulletin saying they will now accept and issue green cards.
The point is that we need to make awareness that there is a HUGE community that gets affected by every move they make and that we are an active and cohesive community and also to create awareness of this debacle.
Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Not been a close tracker all these years, but it all changed at the beginning of October ;)
But, both my wife and I received CPO e-mails this morning. No welcome e-mails.

If you decide to apply multiple 485s with each other as dependents, then file just one first. Wait. Gets its A number and put that number in the other application. This way you will cover one pitfall of multiple filing. It will not cause confusion at USCIS end.
one thing to consider though: with the number of 485 filings that are expected in July, receipts are probably going to take 8 weeks or longer to come through (just ask teh H1B filers this year). By then the PD for the other spouse would have probably retrogressed. Another thing to keep in mind...

I called the USCIS office today. I am on H1b and my spouse is here on H4. I am filling 485 under EB2..
They said clearly that we need to submit I 864 form for support, not I 134 which few people have mentioned in this forum so far..

Our parents/relatives do not need a land phone in India. Send one VONAGE adaptor and they can call any number in India (long distance) and to USA and other 60 countries.
They can receive any calls in a Cell phone (prepaid) (in India - incoming is free).
So just take a broadband connection and Vonage. Bye BSNL/VSNL.........
Remember you are talking about INDIA which is not US. you need broadband connection and Electricity for VOIP and you know the availability and reliability of both in INDIA.

Hi All,
My friend whose PD is Dec 30 2004 - EB2 - Texas got his approval email. But he is already in india and travelling back this Oct 12th.
He already has valid Advanced Parole with him.
He wants to if there are any issues for him to enter at port of entry?
Any documents or print out of approval etc to be carried with him?
Does he needs to tell the office that his GC got approved?
Please help.
no trouble he can simply re-enter on advance parole. no need to carry any proof of approval of GC

my lawyer said yes, the important things are that:
1. you must be married before teh I-485 is approved; otherwise the dependent needs to be sponsored under family petition etc. However note that in this case the dependent would be starting his/her I-485 at that point (when you are already approved) so will 'catch up' to approval later (and if dates retrogress, then the dependent is 'stuck' longer, without GC, while you will have your GC and all related benefits (ability to stop working, change types of work etc))
2. the date needs to be current for the dependent to file, but the fact that you got approved means that your PD is current (as you can only get approved when your PD is current)
Also, if I become a beneficiary on my wife's application, will I be able to maintain my H-1 status, and keep on renewing it?
yes you can continue on your H1
My wife and I are now leaning towards independent filing, with no beneficiary for now.
we are still undecided, same boat. Warnings from some attorneys (as Pappu has pointed out above) are making us think of filing independently, with teh risk that one person gets GC first and the other would than tag along maybe an year or whatever late depending on how dates move/stay.

We can route the pizzas to hospitals and orphanages, shelter for the homeless etc also.

Lou Dobbs and CNN runs an hour long "Hate Immigrants" Program every night Monday to Friday. He repeatedly calls US immigration as a failed system, H1-B and L1...as cheap labor and stealing American jobs, he has big problem with China and China's developing economy, He blames foreigners for bad economic condition of California. He proudly uses the word "Illegal Alien". His program "Lou Dobbs Tonight" is nothing less that someone in Iran running a hate show against America. Lou Dobb always called CIR as "So Called Grand Amnesy"! Once this July visa bulletin fiasco settles down, we need to get together and attack this guy, every night so that he can stop his hate propoganda.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(
That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.
USCIS cannot revoke AC21.. only congress can. Please dont be paranoid. The most USCIS can do is refuse to change their current stance on same/similar job.
