    At any International Airport go to US Customs and Border Protection Office. Show then the I-94 with incorrect name along with your passport that has the correct name and they will be able to fix the issue.

    My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.

    If she transfer her H1B to new company.
    1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
    2. Can she use Premium Processing for H1 transfer?

    #1 - Yes, as long as the PERM is pending and at least 365 days old at the time of filing H1B extension
    #2 - Yes, Premium processing available at the additional cost of $1000

    Nobody other than the USCIS will know, so if you get any any replies, do not believe them.

    If you have waited like me for 6 years to get your Labor Certified, then be prepared to wait another 6 years for 140, even if your PD is current and watch others who filed 5 years after you get their GCs.

    I urge IV to raise one issue at the DC Rally. Please please ask Mr. Chertoff to do away with this farce called "Priority Date". It is an useless concept and should be done away with immediately. Everyone knows that the GC process is totally random, so why have something known as a "Priority Date" when it is anything but a Priority Date.

    "I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Thanks in advance for your response."

    All,

    My 4 years and 2 months on H1B will finish in this November and we are in the process of applying for an extension. I have my 140 approved and waiting for my priority date to become current.

    Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).

    Also, please can you specify the USCIS rule under which it is applicable?

    You can apply directly for a 3 year extension based on your I-140 approval.

    Reciept notice should be recieved as soon as USCIS recieves the application. It shouldn't take much time though I kind of feel it should not take more than couple of days from USCIS part to send the reciept and then 4-5 days for postal reciept. I guess in about weekdays time after reciept at USCIS, you should recieve the notice.

    This is just my understanding. Also some one said, you can start working for the new company as soon as your application is delivered to the USCIS. Get this confirmed by some one.

    Hi Guys

    I was working with a company on H1b and i left to india for a vacation on aug 13 . got stuck in india due to some personal reasons.
    I got paid till aug 30 as i had leave sanctioned till aug 30.
    came back to US on dec 30.
    Didnt get paid for the month of sept oct nov dec.
    But i was never out of status as I was in india.
    now can i apply for a h1b trasnfer as i m getting a job with a very good company with good salary.
    i have paystubs till aug 30 2009. never out of status .

    Hello,

    I need an urgent information. My visa stamping in my passport got expired, but I have valid I-797 document. I am planning to have my visa restamping in India. I came to know that with expired visa stamp we can not travel via UK and France. Can you please advice if I can travel via Frankfurt, Germany? or do I need to get a Transit Visa.

    Anyone who has travelled through Germany with expired H1B visa stamp?

    I have to travel within a week and I would appreciate your advice.

    Never give childcare as a reason. INS treats this as employment for parents. But religious ceremony for child may work. For medical stuff, I'd say that you need to show that either they cant travel or they are under some treatment here. For both the reasons, you need a US doc to write a letter. The best reasons are travelling to different places in the US.

    She could join from the day when the papers for transfer was mailed, this is as per AC21 law. She does not need to wait to receive the receipt from USCIS.

    my wife is moving to another employer. they filed her h1b transfer 2 weeks back. does anyone have an estimate on when she should get here receipt???

    Me and spouse got the "Card production ordered" and "Welcome notice" emails today morning.

    Here is the journey:

    Nov.2002 - RIR Labor filed in CA
    June 2006 - Labor approved from Phily BEC
    July 2006 - I-485 , I-140 filed at TSC
    Sept.2006 - I-140 approved
    Got stuck in namecheck ( name check may be still pending )
    May 20, 2008 - RFE received for missing TB Skin test ( doctor screwed up)
    June 4, 2008 - Responded to RFE
    June 16, 2008 - Green card approved
    Now, waiting for the actual card to arrive.

    I think
    - For Perm and subsequently I-140, you can only specify employers that are directly relevant to the number of years of experience claimed in labor. The details of the petitioning employer are most relevant and all your past employments should add up to the experience required
    - However, for I-485, which is your application, you have to specify all the employments that you filed taxes for and from whom you received your paystubs (primary/secondary).

    There is a quirk in the SSA software! I applied for SSN for my two sons on August 31, 2007. Two weeks later I got the card in the mail for one son. After waiting another three weeks I went back to the SSA office and found that the application for the second son had been deleted! I was asked to resubmit the application which I did. After two weeks the card arrived in the mail but guess what? The card had my second son's names but the SSN already assigned to the first son.
    Another trip to the SSA office revealed that their system would assume it's the same person if the first three letters of the first name and the first three letter of the last name as well as address match! Who would design such a matching algorithm? Why did they not match on birth date as well?
    Anyway, I went back to the SSA office today and a new number is yet to be assigned to my second son! I was told the application is now with their headquarters where someone will manually assign the number.

    I am changing jobs from ohio to another state ,job title and description are same..but the pay mght be 20%less....

    Is this gonna be a problem or is it ok if the new pay is more than the prevailing wage for that state..for the same job description.
