infact it would be better if finance gurus and others on the forum can help list various ways in which h1b visa holders suffer financially by not having a gc.

This particular case http://www.murthy.com/news/n_combdg.html refers to a 3 year degree + a 1 year education degree where the first degree was required for admission into the education degree program. It is not the same as a 3+2, which, however, there is an unpublished AAO case to support its equivalency to a Masters degree.

Why the heck is USCIS bothered about your bachelors when your Labor clearly says Masters required? I think you have a strong case since the RFE did not mention anything about your bachelors. What is your attorney saying? why didnt your ed evaluator mention anything about your bachelors? Will it help if you could evalute your qualifications from another agency, wherein they could prove that you had enough credits and class hours in your bachelors to be equal to US 4 yr courses?
I am sure there are many helpful folks on this forum who could also guide you on your case. They may have had first hand experience in such situations. Do keep us posted.

If true this would REALLY benefit a lot of spouses especially someone like our core member Shilpa.

Is this a new "law"? I thought USCIS cannot pass "laws" on its own. Or this simply an intepretation of an existing legal procedure ---- which I understand USCIS is allowed to do on its own?

I too spend 1500 in 2006 becasue dates were not avaialble in india at that time... ( Iremeber ( 2-3 ) months waiting was there .. and Canada has 1-2 weeks.

Forward movement sounds good..but even with PD current(May,June VB's) folks are just sitting and waiting..just like me..:(

I was wondering if update is only available through state chapter? If so we are in blackhole,,, as many of us are not members of state chapter..
Or if we have more action items to act on apart from calling reps..chc and lamar smith ?
Neways.. i have asked for NC state chapter enrollment ..so hopefully i'll get the updates from then on...:)
there is only one action item right now and it is on the forum.
the update and action needed prior to this was handled by state chapters, however everyone is now up to date with what needs to be done.
state chapters are voluntary but very effective in initiating grassroots approaches to our problems, they have also proved very effective with focussed actions recently. a state chapter is simply a local community that networks and offers support. so it really has many other advantages than just a question of updates.
anyway there is no fresh update currently.

One important observation is that EB2 India/China shouldn't celebrate until State changes their planning style. If CIS wastes visas due to swing movement by State, EB2 I/C doesn't move so much and numbers will be wasted. So it is important that IV push state to incorporate long term planning and add the CIS processing as a lead time to calculate visa dates movement at least for post July 2007.

Please refrain from pushing OP to post employer details on public forum. Let it be OP�s weapon of surprise. I wish OP has contacted an attorney for fighting his case. If this is going to be an out of court settlement, then we shouldn�t expect complete details as well. OP's story should be an eye opener for all of us(Employees and Employers).

Today I was talking to IO in Texas service center, during discussion I told her that India dates might retrogress.. can you please expedite my case. For that she replied that " that's what they are doing"
