YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

I work in a semiconductor company and got laid off last week. My company informed me that they will inform INS to cancel my H1B in May. I plan to go back to school and change my status to F1. My question is, to do a change of status from H1 to F1, will they ask my recent pay stubs? Please reply
Thanks!
Thanks!

Hello ashy15,
I'm in the same situation as you...Mine L1 individual visa will expire by this Sept 2009 and am applying for fresh L1 blanket from my company. Did you get your new L1 blanket visa without any problems? Please reply as it would be of great help to me.
Thanks

I am currently in the US on L1 Individual visa - my current visa is expiring on the 28st of Feb. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I had RFE's on i94 extn. My visa interview is on the 23rd of Feb in Canada.
Am I going to have any problems because I did not extend my visa and applied for a fresh one instead?
Any delay due to PIMS? Do I need to check whether my petition number is in PIMS system?
Any information provided is greatly appreciated.
Thanks....Ashy

u cannot use Canada PR to enter US. If he left US without AP then his application for adjustment of status is considered abandoned.

I moved from Company A to company B towards the end of my H1 6 th year with only a month and half left in my H1. Company B applied for my 140 and 140 was approved just on the day of my 6 year completion. H1 transfer was filed in parallel in normal processing. H1 transfer has got an RFE now a day after 140 was approved.
1. Will there be any problems in getting the H1 transfer based on the 140 approval with the new company? Please note that I do not have any days left in my original H1.
2. What will the duration of H1 if the transfer gets approved?
3. I am continuing to work based on 140 approval and pending h1 transfer. Please advice is it is ok.
Thanks,
Deepa

Simple answer to so many questions..."Should I attend the rally?" "will this make a difference?" "Will I have to make up my day off?"..etc! No matter what your questions are, here's the answer: JUST COME! Come on guys! We need you! Please come and help, we wouldn't ask if your presence weren't so important!!! We ask because we know this will greatly benefit you!
Do it out of moral convictions. ATTEND BECAUSE IT'S THE RIGHT THING TO DO!!!

IVC needs a member to speak with a reporter. This is for a highly recognized publication in the U.S., but the member must meet the following requirements:
1) The individual must be EB1 or O category; and
2) The individual must have correspondence from the US government documenting the absurd red tape (a letter explaining the delays in their green card, etc).
Please contact us as soon as possible if you meet these requirements or know someone else who is - and are willing to speak with the reporter. It would greatly advance IVs cause to be included in such an article, so please help us.

BTW, the easiest way to get back to H4 status is by reentering the country using H4 visa. For which, you will have to maintain H1 status, if you want her to have H4 status in the future.
I think she/he can change status from EAD to H4 without reentering the country...There is something like change of status ....I am not sure about it...Experts can comments further...

I thought they changed their mindset from having no movement most of the year then jumping ahead several years in the last quarter and playing catch up.. this is what got them the 07 fiasco
but apparently they are repeating the trend
this no movement for ROW makes no sense at all
Seriously, I was disappointed with the JAN 09 VB. I am thinking of applying for EB3 to EB2 but I don't know if I can do that. I had two years experience before joining my current employer and now I have served almost 6 years with them that bring it to total of 8 years.

aguy,
You are eligible for 1yr extensions. If your I-140 is approved, you can get 3 yr extensions. Since you are saying it is NIW, it is always better to be on H1 because those cases are approved after intense scrutiny. Where was your I140 application sent?

USCIS is going to issue two year EAD starting at the end of June 2008 for those AOS applicants whose cases USCIS expects to get deleyed more than a year.
"
I'm also pleased to announce that we will be extending the validity period of the employment authorization documents that we issue to individuals who are waiting adjustment of status to lawful permit residenture or in colloquial phrase, the green card.
Currently, adjustment applications are granted employment authorization documents with only a one year maximum validity. Beginning later this month, we'll start issuing these documents with a two-year validity period for aliens who are waiting adjustment of status if their application is expected to be pending for more than a year."

I am a H1 getting married to a citizen. We are planning on getting married in IL. Are there any rules on documents required on my part to even apply for a license? And then for the marriage ceremony (we plan to have a small civil ceremony). I am pretty confused by all the different advice.

H1B Visa Lawyer Blog Has Just Posted the Following:
Secretary Janet Napolitano of the Department of Homeland Security (DHS) announced (http://www.aila.org/content/default.aspx?docid=32175) on June 3, 2010 that the U.S. and France have established an arrangement to implement the Immigration Advisory Program (IAP), which allows for the identification of high-risk travelers at foreign airports before they board aircraft bound for the U.S. This arrangement has been launched at Paris Charles De Gaulle International Airport. A similar arrangement was entered into on July 1, 2009, implementing IAP at Madrid Barajas International Airport.
The purpose of the IAP is to allow specialized U.S. Customs and Border Protection (CBP) personnel posted in foreign airports to utilize current targeting and passenger analysis information and/or an assessment of passengers documentation to identify high-risk persons bound for the U.S. and to make no board recommendations to carriers and host governments.
Secretary Napolitano believes that the IAP arrangements will enhance the capabilities of both the U.S. and foreign countries in which we have collaborated with to protect our immigration systems as well as the global aviation network from abuse by terrorists and transnational criminals.
DHS currently has IAP arrangements with seven (7) countries and operates at nine (9) locations.
