Hello,
I am a US Citizen who applied through I-130 form for my married daughter since 2001. She and her husband came here with a tourist visa in 2003 and they overstayed it for a period of 6 years. In the meatime, they had 2 americam kids. They are still in the USA.
I am starting to receiving document from NVC to pay $70 for Affidavit of Support for their cases. I would like to know if an Adjustment of Status can be made for them here in the USA as the immigration does not know where they are right now. I presumed also that they can't return back to their country of origin cause they've been here for so long that they could get caught and get penalized. They have never been employed but received support from the family members and their kids received welfare aids.
What can be done if I want to Adjust their status here? Thank you already for your answers.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. I think this is a step forward...but aint cutting it...your status remains "in process for years"...everyday check the same url and it says gives the same stale status...what we need is a way to make a resonably accurate guess as to when my LC will go into the next stage..

Hello,
I am going to Chennai for my visa stamping and the consulate website says that I need to present the " complete I-129 petition submitted by your prospective employer including the Labor Condition Application " during the interview. Can any one tell me if the photocopy of those documents will do or do I really need to carry the originals (which I don't have)?

Hi,
Wanted to know if there is any limitation on H4B visa date for coming in to US. My wife's H4B visa ends on Sep28 2009, she will travel and will be back on 28th Aug 2009. Is there any problem since its only 1 month from expiry.
In the meantime I will apply for an H1b extension.

I believe you should be using your EAD + AC21 after 6 months of filing 485.
did you check elsewhere in the forum, I have seena lot of communication about it before here.

you can use AC21 with H1 transfer also. Using EAD is not mandatory.

Well, the first thing that I noticed was not the ceiling, but rather the cute little Shetland Sheepdog in the middle of the walkway. Of course, I love dogs (and especially Shelties)... ;)
I think if I stare at the image long enough, I can sometimes see the effect you're talking about, though it's not like that effect jumps out at me. IMHO, this picture is still a good study of geometric forms, whether or not it has issues with optical illusions. :)

Hi ,
Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?
