i think this is just another interim or supplemental memo. Oh's website says that the rule making agenda for ac21 has been pushed out until next year.
About 2 weeks back Murthy posted an article in it's bulletin "new AC-21 regulations expected soon" http://www.murthy.com/mb_pdf/050208_P.html which i believe was a result of some discussions USCIS had with AILA?
Now is this new AC-21 memo released today the one being referred to in the above mentioned Murthy bulletin? OR i should still hold my breath for more AC-21 changes coming from USCIS, so they can jeopardize status of people by changing their interpretation of laws every now and then? Anyone?

To my understanding you can use EAD and then switch back to H1. However, it is still unclear if one can do job on EAD as well as hold the H1 status.

When we file for I-485, what document do we need to attach to the I-485 form?
Do we need valid Passports?
In general a person who is in the US should have a valid and unexpired passport at all times. In addition, there is a whole loooooong list of documents that you attach to the I485- your attorney should advise you on this. The most important once for employment based immigration are documents showing legal status up until the I485 application and current offer letter from your company. There are many many more documents you need to provide...search the net for the necessary documents...

The dream act is an awesome legislation, my dad was one who sent his application for I-485 and it was received on the 2nd of july. However, due to the July visa fiasco he is stuck like the rest of you guys. My point is rather that I aged out in June 2007 and could not be added with my family, for the month of July. I would receive benefits because this would put me out of status as well...also children of illegals are still children. They are not illegal because they did not choose the right to come here but came without any knowledge. So Please everyone take your time to call your respective senators and email them. I received a soft lud on my H1B approved in Nov 2007. All other cases do not have any LUD. I guess it is just the system touching these records as routine maintainence.
but I got soft LUD's on all my cases after using AC21.
Here two things happened
1. applied for h1B transfer using approved I 140
2. sent AC21 letter
so don't know what trigerred the soft LUD's

I think he is just trying to scare you. There is no way he can sue your for his losses. Evey employer has an insurance against his employees in case there is any mistake by his employee this insurance covers it. He cannot prepare any case against him so just tell him to shut up and go to hell.

Oh No ! Thats too bad. I was really hoping that it was possible to use the old H1B. And can be used anytime to change the status.

I am in exact same situation. The company that is going to sponsor my H1 checked with two attorneys and both said that I will need a fresh H1 in April07 and I can start working from Oct07. Even I never got to work on my earlier H1. I guess this is because you need previous paystubs for H1 transfer. Let me know if you hear otherwise from your attorneys.
I am hoping someone wud come up and say Yes its possible.....
