Yes, this is very common. BTW once IO at POE made an error and give I-94 till 3 years when my I-797 was expiring in less than a year. Immediately came back to him and brought to his attention and he corrected it.

Another great design, but the text seems a bit off with the design. For the most part, in a stamp, the text should be the consistent, dull part. In my view, it doesn't look nice when italicized or stylized excessively.

If one applied for his I-485 before the H-4 visa was expired, then not a problem. The minor could obtain a new h-4 visa stamp overseas. He / she should take AP with her / him just in case they can't issue a visa for any reason.
Generally speaking, one who has a pending form I-485 is not obligated by law to maintain any other status such as H-1 or H-4 and the time after the expiration of such a status is not counted as unlawful presence as long as the pending i-485 is not denied.

My AP was approved Nov 16. Email from USCIS said approval notice sent. I had to travel Dec 4th. When my lawyer contacted USCIS on Nov 25th, USCIS said they were in the process of printing the form. My lawyer suggested trying for the emergency AP. The Baltimore office says walk-ins not allowed. My travel was postponed for other reasons. Double check that USCIS actually mailed the notices to you.

hi,
I am planning to extend the visitor visa for my mom for another two months.
Her current I94 expires on June 25th and At POE the officer told her that she must go back after 6 months.
If I apply for extension of her visa and in case she does not get any result before current I-94 expiry date, is it wise to stay on or leave US in order to avoid overstays?
2.What happens if she gets a rejection before her current I94 expiry, will she need leave earlier and apply for new visitor visa?

I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
Btw, am not sure of the reason for RFE yet.

I would anticipate EAD to be processed in max of 3 months and AP in 2 months.
Would also add a buffer of 2 weeks (just in case).

Hi guys,
My LCA got denied today (reason unknown) and my H1-B has expired on Nov. 1 as well. :(
I also have a pending I-485 petition with approved I-140. I also have a valid EAD. So I assume, I am currently shifted to AOS pending status working on EAD.
My question is whether this denial negatively affects my pending I-485 application? I assume not but just wanted to confirm anyways :confused:

My father passed away recently and my mother wishes to travel with my wife and I on a visitor visa.
How can she apply for 10 year multiple entry visa? Can she return after the visa expires, after a month? Any experiences anyone can share? Are there any reasons why some visas get denied?
My wife and I are permanent residents and we want to know whether this is of any advantage/disadvantage.
Any pointers/info/help are much appreciated. I looked through the relevant IV threads and yes, they are informative but rules change all the time and I decided to just go ahead and post this thread to get the latest feedback.
Has your mother gotten US visitor visa before? The most important point is to prove to the consulate that your mom will return back from USA. To prove that you need to show some strong ties in your home country. Now that she is a widow it can work against her unless your siblings are still in india. All other things are secondary.
The number of years for the visa can range from 3 months to 10 years and it depends on how strong your mother's case is.

Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.
You can apply of AOS i.e I 485 only for one application . Since you already have applied for AOS on EB1 I highly doubt u can apply for AOS for EB2. Talk to your lawyer and find out

2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
